The period of conditional residency for someone who obtains residency or a “green card” through marriage when they have been married for less than two years.
To remove the condition and obtain permanent residency, both spouses must file a “removal of conditions” petition during the 90 days before the conditional green card expires.
For example:
The marriage ended due to divorce or annulment, even if the marriage was contracted in good faith.
The conditional resident and/or children have been victims of spousal abuse or domestic violence.
Death of a spouse.
