USCIS Affirmative Asylum Process

A person who is not in court can file an asylum application with the immigration agency. To do this, the person must be physically present in the United States.

The first step is to file an asylum application with the agency and provide evidence demonstrating that you have been persecuted or are at risk of persecution if you return to your home country. The individual will be scheduled for an interview with an asylum officer.

If the person wins their asylum case, they have the right to stay and work legally in the United States. One year after winning their asylum case, they will be eligible to apply for permanent residency. But if the asylum officer denies the case, the person will be referred to an immigration judge, thus initiating removal/deportation proceedings. The final decisions of asylum officers are not appealable. The person will have a second chance to present their asylum case before the Judge.

Defensive Procedures in Immigration Court

Defensive asylum occurs when a person is before an immigration court and requests asylum as a defense to removal proceedings. The asylum application will be heard by an immigration judge who will independently evaluate the case. To win asylum, the person must provide evidence demonstrating they have been persecuted in the past or are at risk of persecution if they return to their home country.

A person who wins an asylum case can legally stay and work in the United States. You can apply for permanent residence one year after winning your asylum case.

If the Judge denies asylum, they will issue a removal/deportation order. Before deportation, the individual can appeal the Judge's negative decision to the Board of Immigration Appeals (BIA).
